PRIVACY STATEMENT

Participants to the Artzept Competition

Home Art & Sales Services A.G. (“Home Art”), is aware of the importance of protecting the personal data and, in its quality of Data Controller, informs that the personal data deliberately provided by the participants to the Competition Artzept (respectively, the “Data Subject” and the “Competition”) will be collected and processed in compliance with the European and national legislation.
Pursuant to Article 13 of Regulation (EU) no. 2016/679 (the “Regulation”), Home Art provides the following information.

  1. Types of data collected. During the Competition, Home Art processes the following data deliberately provide by the Data Subjects: (i) personal data; (ii) contact details; (iii) biography; (iv) any other information requested to participate (the “Data”).
  2. Purpose and legal basis of the processing. The Data will be processed for the following purposes:
    1. to allow the Data Subjects to participate to the Competition. The legal basis of such processing is art. 6 par. 1, lett. b) of the Regulation since the processing is necessary for the performance of a contract of which the Data Subjectis a part of or for the performance of pre-contractual measures adopted at the request of the Data Subjectis;
    2. to discharge obligations resulting from the law in accounting and tax matters. The legal of such processing is art. 6 par. 1, lett. c) of the Regulation, since the processing is necessary to fulfil a legal obligation to which the Data Controller is subject;
    3. to assert or defend a right in court. The legal basis of such processing is art. 9 par. 2 lett. f) of Regulation, or as the processing is necessary to ascertain, exercise or defend a right in court;
    4. to send promotional material to the data subjects through e-mail, SMS, MMS and instant messaging for their own services and products, and those of third parties as well as to carry out, for the same services and products, direct telephone marketing activities. The legal basis of such processing is art. 6 par. 1, lett. a) of the Regulation, since the Data Subject has given his/her consent;
    5. to publish data on the Data Controller public channels (both analogue and digital). For this purpose, only common data will be processed. The legal basis of such processing is art. 6, par. 1, let. a) of the Regulation, since the Data Subject has given his/her consent.
  1. Data retention period. The Data processed for the purposes referred to in points 2.a, 2.b and 2.c will be retained for the entire duration of the contractual relationship and then immediately removed, with the exception of those necessary to comply with fiscal, accounting and administrative regulations or to fulfill other legal obligations and document the activities performed. In those cases, the Data will be deleted in the terms provided for by the aforementioned regulations.
    With regard to the Data processed for the purpose referred to in point 2.d, the Data will be retained for a period not exceeding two years from their provision.
    The Data processed for the purpose referred to in point 2.e will be retained for the period necessary to promote the Competition, not exceeding two years from their provision.
  2. Modalities for the processing. The Data will be stored and processed with electronic tools and will be saved both electronically and on paper, organized in a database, and on any other type of appropriate support. Specific security measures are followed to prevent data loss, illicit or incorrect use and unauthorized access. The processing carried out by Home Hart does not involve automated decision-making processes.
  3. Provision of Data. The provision of Data is a necessary to participate to the Competition and therefore mandatory for the purposes referred to in points 2.a, 2.b and 2.c of the policy: in default, the Data Subject will not be able to participate. The provision of Data for further purposes is optional: in default, no consequences will affect the Data Subject.
  4. Communication of Data. The Data may be communicated to: (i) subjects who are entitled and have the interest to access to the Data; (ii) Data Controller’s internal staff; (iii) companies, associations or professional offices that, appointed as Data Processors (“Processors”), provide services and activities on behalf of the Data Controller for the fulfilment of legal obligations as well as for every organizational and administrative need necessary to provide the services requested. The details of Data Processors are listed in an updated list available at Home Art premises (to be requested at the addresses indicated in point 9).
    The Data may be disseminated by Home Art, under Data Subject consent, by paper (catalogues) and telematic (social network) means to promote the Competition.
  5. Transfer of Data outside the European Union or to international organizations. Home Art does not transfer the Data to international organization. Being a Swiss Company, Home Art will transfer the Data outside the EU, according to art. 49, par 1, lett b) of the Regulation, in order to perform the service requested to the Data Subjects. On the same ground, it may transfer the Data to subjects linked to its group that are located outside the EU.
  6. Rights of the Data Subjects. The Data Subjects have the right to exercise at any time the rights provided for by the Regulation, such as:
    - to obtain information on: (i) Data source; (ii) purposes and methods of processing; (iii) logic applied; (iv) identifying details of Home Art and of Processors;
    - to obtain: (i) access, updating, correction or integration of data; (ii) deletion, transformation into anonymous form or blocking of Data processed in violation of the law; (iii) the limitation of data processing; (iv) copy of the Data in standard format;
    - to object, in whole or in part:
      (a) for legitimate reasons, the processing of the Data, even if pertinent to the purposes of the collection;
      (b) to the processing of the Data necessary (i) for the performance of a task carried out in the public interest or in the exercise of official authority vested in Home Art or (ii) for the purposes of the legitimate interests pursued by the controller or by a third party, included profiling;
      (c) to the processing of the Data for the purposes of sending advertising or direct sales material or for carrying out market research or commercial communication;

    - to revoke the consent to processing, when this is based on the hypothesis provided for by art. 6, par. 1 (a) (when "the data subject has given consent to the processing of their personal data for one or more specific purposes"), or by art. 9, par. 2 (a) (when “the data subject has explicitly consented to the processing of such personal data for one or more specific purposes”) of the Regulation, at any time without prejudice to the lawfulness of the treatment based on the consent given prior to the revocation. In particular, in order to no longer receive e-mails or promotional mail, the Data Subjects can at any time request a free cancellation from the service by sending a message to the addresses indicated in point 9 of this statement. If Data Subjects consider that the processing of the Data is in violation of the law, they have right to lodge a complaint with a supervisory authority, particularly in the Member State in which they usually reside or work or where the alleged violation has occurred. The Supervisory Authorities can be reached at the addresses on their own website.
  7. Data Controller. The Data Controller is Home Art & Sales Services AG with registered seat at Sihleggstrasse 23, 8832 Wollerau (Switzerland) VAT no CHE 103.486.852, in the person of the legal representative pro tempore. Home Art may also be contacted at the e-mail address info@incoman.com and at the address Sihleggstrasse 23, 8832 Wollerau (Switzerland). To exercise the rights listed above, the Data Subject may make a request using the e-mail account info@incoman.com. Home Art retains the right to update this personal data processing policy.
